General Terms and Conditions

1. General
All deliveries and services of S. Sutter Engineering and the associated online orders as well as other online services, are subject to these General Terms and Conditions (GTC). Deviating and/or supplementary agreements require the express consent of the management of S. Sutter Engineering as well as the written form.

The version of our general terms and conditions current at the time of contract conclusion applies to all business relations between S. Sutter Engineering and its customers. By completing your order, you confirm that you have read and accepted these terms and conditions. other terms and conditions require written confirmation from us.

The images of our products in the online store are not legally binding, but serve only as a visualization. If you merely place products in the "shopping cart", this is not considered a binding order. The order becomes binding only when you click the "Order" button on the order page. You will immediately receive an order confirmation from us by e-mail, upon receipt of which the contract is concluded. The acceptance is subject to the legal admissibility and availability of the ordered goods or services. Products which are temporarily not available must be ordered again. The availability display in the online store serves only as information, it may be inconcrete in special cases.


2. Availability

Offer valid as long as availability. Subject to change and errors excepted.    


3. Delivery

S. Sutter Engineering will, as far as possible, comply punctually with agreed or stated delivery times. If these are exceeded by more than six weeks, the customer has the right to set a grace period with the indication that he refuses to accept the object of purchase (here vouchers) after expiration of the period. This grace period must be at least one month. If then an agreement on a new delivery date is not reached, the customer can withdraw from the contract, respectively from the conclusion, after expiration of the grace period by written declaration. Damages due to delay or impossibility of delivery cannot be claimed. This also applies to claims for damages due to loss of profit or other indirect damage. Further claims of the buyer - especially for delivery - as well as for risks and side effects possibly caused by the product, are excluded. The risk passes to the customer as soon as the goods (in this case vouchers) have been handed over to the carrier and have left the warehouse or the company. This also applies if S. Sutter Engineering has assumed the transport costs. Complaints due to transport damage must be made by the customer to the transport company within the time limits provided for this purpose. In the case of shipments by the customer, the customer shall bear all risks, in particular the transport risk, until the arrival of the goods at S. Sutter Engineering.


4. Payment

You can pay by invoice in the online store at www.ssutter.com. Invoices from S. Sutter Engineering are due immediately and payable without any deduction. Offsetting is only permitted with undisputed claims or claims that have been legally established by a court of law. The customer may only assert a right of retention if it is based on the same contractual relationship.


5. Right of withdrawal 

There is no right of revocation for vouchers that are paid for online and printed out. Vouchers paid by invoice can be revoked within 24 hours and must be returned to the issuer within 3 working days (from receipt). 


6. Defects

Complaints regarding the scope of delivery, material defects, wrong deliveries and quantity discrepancies must be made in writing immediately, at the latest, however, within one week after receipt of the goods or the vouchers, insofar as these can be determined by reasonable examinations. In the case of justified complaints, S. Sutter Engineering will correct the incorrect delivery free of charge and otherwise, subject to exclusion, will at its discretion exchange the vouchers, take them back or grant the purchaser a price reduction. If, in case of exchange of a voucher, the replacement delivery is also defective, the purchaser shall have the right to rescission or reduction.


7. Customer data

S. Sutter Engineering is entitled to collect, store and process the customer's personal data required within the scope of the business relationship, taking into account the corresponding duty of care in the sensitive handling of customer data.


8. Final provisions

The invalidity of individual points of these General Terms and Conditions shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a new provision which comes as close as possible to the invalid provision in terms of its economic effect. The provisions of the Swiss Code of Obligations shall apply. CH-9213 Hauptwil is the exclusive place of jurisdiction for all disputes arising from a contract with S. Sutter Engineering.
